CONTRACTORS and developers must adhere to the latest guidelines on providing accessibility for disabled persons in new development projects in Kuala Lumpur as released by the Department of Standards Malaysia.

Kuala Lumpur mayor Datuk Seri Ahmad Phesal Talib said Kuala Lumpur City Hall (DBKL) was serious in ensuring that all facilities built by contractors and developers are according to the MS 1184:2014 Universal Design in The Built Environment — Code of Practice (second revision).

“This guideline shows the seriousness of the Government to enable local councils to pay attention to accessibility of facilities for disabled persons and senior citizens,” he said in his speech before launching the Seminar on Universal Design and Accessibility for Building Contractors yesterday.

He added that DBKL’s procurement committee took into consideration the low prices offered by contractors and the quality of the facilities.

The MS 1184: 2014 was approved by the Science, Technology and Innovation Ministry on June 3, added Ahmad Phesal.

“The rapid and progressive development in the country needs to take into consideration the needs of the disabled by preparing buildings that are planned and built according to universal design.

“It is a design that is user-friendly to everyone and not categorised for only the use of the disabled, children or pregnant mothers,” he said.

The seminar, he said, was to give exposure to contractors and developers in the building industry to include facilities for the disabled in every project in a barrier-free environment, using a universal design.

Ahmad Phesal added that they would recognise buildings that included facilities for the disabled.

He gave an example of a universal design in the 1Malaysia Development Berhad building in Jalan Sultan Ismail, which included a ramp instead of a staircase for the public.

On the upgrade of Jalan Alor, Ahmad Phesal said RM12mil had been allocated but there was a delay.

“We have to get the opinion of traders and other stakeholders in the area on the plan.

“We are also refining the design of the plan as we must take into consideration the utilities such as the pipes,” he said

Ahmad Phesal had announced on Aug 22 last year that the project to turn Jalan Alor into a food paradise would begin in October last year and completed in 11 months.

He had said the upgrade was consistent with the Visit Malaysia Year 2014 and also in preparation to make Kuala Lumpur a world-class city.

Legality of new projects should be determined before being approved

Our government exists because we need them to enforce laws. After all, in a society made up of millions of individuals, there are bound to be disputes and disagreements.

And to resolve these disagreements, the government need only to look at existing laws to see if the matter can be resolved, and if not, it becomes incumbent on the elected representative to propose or amend the law in an attempt to resolve the dispute.

Recently, a group of disabled persons protested outside the Bukit Gasing Sivan Temple as they have been barred from entering and worshipping at the temple.

Rather than attempting to resolve the dispute, both the Petaling Jaya City Council (MBPJ) and Bukit Gasing assemblyman Rajiv Rishyakaran have distanced themselves from the issue.

At the April 30 full board meeting, Petaling Jaya mayor Datin Paduka Alinah Ahmad said MBPJ could not interfere in the dispute because the building was illegal while Rajiv said on his Facebook page, “I feel that in the bigger picture, it is not wise to ask for the government to intervene (in) religious rules or decisions.

“I feel it is the right of those professing that faith to dialogue, discuss and demand. But do we really want the government to start commenting and enforcing rules that interpret our various faiths?”

Despite his well-meaning intentions, both the council and Rajiv failed in their respective duties to uphold the law. Firstly, the development of any structure comes under the purview of the local council as officers need to scrutinise and ensure buildings comply with the Uniform Building Bylaw (UBBL) requirements.

One of those requirements reads as follows: “Any building or part thereof to which this by-law applies shall be approved with access to enable disabled persons to get into, out of and within the building for which access is provided wholly or mainly for the inspection, maintenance or repair of the building, its services or fixed plant or machinery; and be designed with facilities for use by disabled persons.”

Coming back to the Sivan Temple case, it is an illegal structure because it was built on a forest reserve.

It has no land title and did not submit any building plans to MBPJ (the temple committee could not have submitted the plans anyway since they are not the landowners).

Since the temple has no land title, the law requires the entire temple to be demolished, but such action cannot be taken because the Selangor government put a freeze on the demolition of any religious buildings after severe political backlash from the Hindu community over the demolition of several temples.

So the law cannot be enforced because of religious sensitivities; but did the government not allow this problem to start when the temple was set up illegally in the first place?

And the government is notorious for overlooking legal requirements when approving development projects. Take for instance the proposed new development in Section 17, Petaling Jaya on the former Sentosa Cinema site.

The project consists of two blocks of apartments that are 18 and 19 storeys high and situated on a piece of land slightly under two acres in size with a portion of the project taking up part of the road reserve of Jalan 17/27 where the wet market presently operates.

Now, I have highlighted that it is illegal for developers to apply to build on publicly-gazetted roads because these are simply not part of the developer’s property and that rejection should have been automatic as per the Town and Country Planning Act.

Be that as it may, one of the market traders told me that the project on the road was supposedly a multi-storey structure to house the market traders and that the traders are all agreeable to it after looking at the proposed plans.

So who is the owner of this building and who has the land title (how do you even get a land title for a road reserve)? Who maintains the cleanliness and repairs for the building? What about defects in the building, who would be responsible for the defect liability period? Will this be under MBPJ’s responsibility or the developer’s?

Does this building have lift facilities to enable the disabled to access the building? If it does have lifts, who maintains it? If it does not, should the project not be allowed to proceed?

These were questions the trader could not answer because the information was not provided to him or to any of the other traders.

Hypothetically speaking, should this project be allowed to proceed and we find out that the disabled do not have access to the building; would the authorities decline to intervene just like in the Sivan Temple case?

UNFAIR: The Damai Disabled Person Association Malaysia members are unhappy with temple’s committee for implementing a new rule which prohibits wheelchair-bound worshippers

PETALING JAYA: WHEELCHAIR-BOUND Hindu devotees were shocked when they were told  that they were not allowed to enter the Maha Sivan Alayam Bukit Gasing temple  grounds to pray, just because wheelchairs were no longer allowed there.

This is the blatant discrimination that Aveena Devi, 21, who is wheelchair-bound, had to put up with when she went to the temple recently.

A signboard at the temple states, among others, that wheelchairs are not permitted within its premises.

This ruling prompted members of the Damai Disabled Person Association Malaysia to stage a peaceful protest in front of Sivan temple's entrance gate recently.

Some 70 people including 50 members of the association, with their friends and families, turned up to voice their dissatisfaction over the matter.

Damai Disabled Person Association Malaysia president Murugeswaran Veerasamy, 44, said the peaceful protest was held to take a stand against the temple committee's unfair policy towards the disabled.

"Everyone should be able to go and worship where they want to, according to their own beliefs, whether it is a Hindu or Buddhist temple, mosque or church.

"It is also unfair that some places of worship are not disabled-friendly and bar members of the disabled community from going there to pray," he said.

Murugeswaran claimed that Sivan temple president T. Maharathan had said wheelchair-bound people were not be allowed to pray in the temple because the wheels of the wheelchairs might dirty the temple floor.

He also alleged that the president had cited space and safety issues as reasons for banning wheelchair-bound people from praying in the temple.

"This is not the right thing to do as solutions should be found to allow all Hindu devotees to pray at the temple. The Street, Drainage and Building Act of 1974 clearly states that religious buildings are also included in the list of places that the disabled community should have access to, just like every able-bodied person," he said.

Aveena's father Krishna Kumar, a businessman, said that he had already made a complaint to the Human Rights Commission of Malaysia and would file a lawsuit against the temple and its committee for the unfair ruling.

There was some drama after the press conference ended when Maharathan showed up and expressed his unhappiness at the members of the disabled community and the public for staging the protest.

After seeing that the protesters were not backing down from their demands, Maharathan finally agreed that the signboard outside the temple's gates which states that wheelchair-bound members were barred would be changed soon.

He also agreed to allow Hindu wheelchair members of the community to pray in the temple in future.

Rajiv Rishyakaran reaffirms that he is fully committed to carrying out his duties as a state assemblyman without fear or favour.

PETALING JAYA: Selangor state assemblyman Rajiv Rishyakaran pleads to Hindu Sangam to organize a religious discussion between temple officials and the disabled community to reach an amicable solution.

“I urge and plead with the Hindu Sangam to step up to their duty as the representatives of Malaysian Hindus and help organize a theological discussion between both parties so that a solution can be reached,” Rajiv said.

He explained that the discussion will certainly clear up the lingering matters that both the disabled community and the temple officials are dealing with.

“They should have a calm and rational dialogue taking into account different issues or ideas and come to a respectful resolution,” he added.

Rajiv said this in response to the Disabled Persons Association Of Selangor & Wilayah Persekutuan’s (Damai) peaceful protest yesterday morning at the foothills of the Bukit Gasing Sivan temple which ended with verbal arguments between them and the temple president.

“This is a sensitive issue. Government officials should not dictate how a religious body conducts its business. It will lead to all sorts of problems.

“This is an issue which must be solved within the community itself,” he pointed out.

Rajiv also urged other temple associations to weigh in on the matter.

“It is best to have other temples engage the Bukit Gasing Sivan temple so that an exchange of ideas and solutions can come to pass,” he proposed.

Meanwhile, Rajiv further said that he was in touch with the temple and that this issue must be solved within the community.

“I am in touch with the temple and that this is an issue which must be solved within the community itself and that other temple associations ought to weigh in and assist in the matter.

Rajiv gave assurance that he is fully committed to carrying out his duties as a state assemblyman without fear or favour.

  Rajiv Rishyakaran, you just simply don't get it at all do you? And it's really pathetic to see that neither to your so called "advisers" in the DAP who haven't had the courage to speak up. It's all about showing your solidarity with the disabled citizens of Petaling Jaya who voted for you. Do you need to be in a wheelchair and chased out of a temple or church or whatever before you understand? Stop passing the buck young man. Grow some. Get your councillor Cynthia Gabriel and wheelchair councillor Sia Siew Chin to join you in making a statement that MBPJ is committed to zero tolerance on discrimination on any persons with a disability. Then issue them a warning letter to remove the offending signboard and comply with the building bylaws requirement that all buildings should be disabled friendly from wheelchair carparks to ramps and toilets. If it is not followed, there will be no approval or renewal of licenses. It is unthinkable of you to pass the buck and let a few narrow minded bigoted people to decide the fate of disabled worshipers. Shame on you. Shame on your DAP advisers who refuse to speak up. And most important of all, it is a crying shame to the memory of the late great legend Karpal Singh who was in a wheelchair. (At least Prof Rama from Penang spoke up for the disabled.)

  If you are afraid of ISA (which has been repealed) then you are not fit to be an assemblyman. You should have known that with great power comes great reponsibility. If you cant deliver, just resign. I am sure there are many capable leaders out there who can replace you. This is not a religious issue. Get your facts right. Do proper research before you even open your mouth. This is about discrimination against pwds and sheer arrogance of the temple managment. How can one equate a person on a wheelchair to slippers?   A lot of people have wondered where I stand regarding the controversial temple in PJ banning wheelchairs in the inner prayer area.
  
  This issue was first highlighted over 2 weeks ago (April 9th) to me and MBPJ. I contacted the temple chairman to clarify, and in the following few days I spoke to him a number of times, including making a visit up to the temple to see for myself which parts of the temple wheelchairs are allowed (they are allowed into the premises, but not into the inner prayer area) and where they are not.
  
  I fully understand and feel for the disabled community in this matter. They have already been dealt a tough hand, and to be penalised or excluded for that disability, its beyond horrible.

  IN THE FIRST PLACE THIS TEMPLE WAS PLACED UNSAFE BY LOCAL COUNCIL AND OUT OF BOND FOR WORSHIPERS FOR THEIR SAFETY. EVEN WHEN THE TEMPLE WAS STARTED AS PLANTATION TEMPLE IN EARLY SIXTIES, EVEN THOUGH THERE WERE STEEP STEPS WHEEL CHAIR WERE CARRIED INTO THE TEMPLE. WHY NOW CANNOT

  Rajiv prefer to organize Teh Tarik session rather then organize any event to resolve the temple issue. This happen when inexperience community leader chosen. I saw no improvement in Gasing since he won the election. Rather he prefer show his face for nonsense function then for important issue.Just say you dont have guts to open your mouth.

  You scare to carry out your duty that's why you use ISA as excuses. Most temple have disable lane to go into the temple, I think this president and the management of temple have some attitude problem. Where got people not allowed disable people into the temple, mostly people welcome them.
